URBANA A Champaign man who admitted having cocaine intended for sale has been sentenced to eight years in prison.

Judge Heidi Ladd also ordered Leonard Mann, 23, whose last known address w Oakley Outlet as in the 800 block of North Prairie Street, to pay fines of about $2,055.

Mann pleaded guilty in October to possession with intent to deliver a controlled substance, admitting that on Feb. 23 he had about a half ounce of cocaine in an apartment on North Neil Street.

Urbana police did a court ordered search of the residence, where they found the cocaine in 57 bags, a loaded revolver on the floor, and two children under the age of 2 in the apartment.

Court records show Mann had prior convictions for possession of cannabis and was on probation for possession with intent to deliver cocaine at the time of his arrest.

In other Champaign County court cases resolved recently by guilty pleas or sentences imposed by judges:

Thejuan Merrifield, 41, whose last known address was in the 2000 block of Philo Road, Urbana, was sentenced to six years in prison for domestic battery with a prior domestic battery conviction.

Judge Tom Difanis imposed the sentence after a jury convicted Merrifield in October of hitting and kicking a woman in her Urbana apartment on July 26.

Assistant State’s Attorney Stephanie Weber said testimony was that Merrifield was intoxicated when he showed up. The two argued, he threw her to the floor and hit her in the face, breaking her glasses. As he was leaving, he picked her up and threw her down again, kicking her in the head, Weber said.

Court records show Merrifield had several prior convictions for domestic battery, transportation of alcohol, resisting a peace officer and aggravated battery. Those convictions made him eligible for an extended term. Six years was the maximum he could have received.

Matthew Mayfield, 34, whose last kno Oakley Outlet wn address was in the 2100 block of Seaton Court, Champaign, was resentenced by Judge Harry Clem to six years in prison for burglary. He initially received four years of probation and drug treatment after pleading guilty in August 2010 to breaking into a car in Champaign in March 2009.

He admitted he violated his probation by failing to report to his probation officer and by being kicked out of drug treatment.

Difanis resentenced Stephen Turner, 55, of Monticello, to 3 1/2 years in prison for possession of a stolen vehicle, a crime he pleaded guilty to in 2002. Court records indicate he twice received probation. In October, he admitted that he failed to report to probation for several months in 2008 and 2009.

Court records indicate Turner had a federal drug related conviction.

Ladd resentenced Aarion Lewis, 23, of the 700 block of East Embassy Row, Rantoul, to six years in prison for obstructing justice. Lewis had been sentenced to probation in August 2010 for the 2009 crime but admitted that he violated his probation by using drugs and alcohol and failing to get substance abuse treatment.

Court records show he had two prior drug related convictions.

Joshua Weeks, 17, of Bondville, was sentenced to a year of probation after pleading guilty to intimidation. He admitted that on Nov. 3, he threatened to hurt a Champaign man who had recently sold him a car that wa Oakley Outlet s in need Oakley Outlet of repair.

A more serious charge of attempted robbery was dismissed. Weeks was also ordered to have no contact with the victim.

Andrew Adams, 18, who listed an address in the 2600 block of Brownfield Road, Urbana, was sentenced to a year of probation after pleading guilty to felony theft.

He admitted that on Oct. 8 he stole two cellphones and a iPod from a home in the 1200 block of South Lynn Street in Urbana.

A more serious charge of residential burglary was dismissed.

Joseph L. Hart, 23, who listed addresses on West Springfield Avenue in Champaign and Olympian Road in Urbana was sentenced to 3 1/2 years in prison for violation of an order of protection.

He admitted that on Aug. 23, he came within 250 feet of a Champaign woman who had obtained an order of protection against him.

Man sentenced to 38 years for Champaign robbery

URBANA A 21 year old Champaign man who robbed a fast food restaurant employee at gunpoint, then used the gun to bludgeon her, was sentenced Friday to 38 years in prison.

Under truth in sentencing legislation, Kevin Hemingway, who listed an address in the 600 block of North McKinley Avenue, will have to serve more than 31 years. He already been in the county jail more than a year.

Testimony showed that on Aug. She was confronted by a man with a bandanna covering part of his face who demanded the bags. When she refused to turn them over, he hit her in the head with a gun, which caused her to fall to the ground with such force that her pelvis was dislocated.

Herbst also required stitches to her head and injured her knee.

She testified Friday that she still feels physical pain from the dislocation and suffers from depression.

“I not sleeping like I used to. I have to constantly look over my shoulder. I just don trust people like I used to. I afraid something else might happen,” she said.

To aggravate Hemingway sentence, Assistant State Attorney Troy Lozar presented evidence from three officers at the s Oakley Outlet atellite jail. Two testified that Hemingway was involved in a brawl in a cell block on Oct. 11 while a third said Hemingway ripped pages out of a law library book at the jail in November.

To lessen his sentence, Assistant Public Defender Amanda Riess had two of Hemingway uncles and his brother testify, all of whom said Hemingway was raised by an aunt and uncle, had no father in his life, and a mother who had problems. They also said Hemingway missed his last two years of high school.

Lozar argued for a 40 year sentence the maximum was 45 saying that the crime was a planned and coordinated offense that left Herbst seriously injured. Hemingway and co defendant Charlie Vogel, 30, who listed an address in the 2500 block of Prairie Green, were arrested outside Vogel home not long after the crime. There was a gun in the trunk and on Hemingway police found $1,900 in cash in small amounts bound with rubber bands.

Riess countered that Hemingway had only one prior conviction for possession with intent to deliver cannabis, had not fathered any children and had a strong chance at rehabilitation given his young age. She also noted he was employed for two years and helped his family financially.

Hemingway asked the judge to “show m Oakley Outlet ercy” to him.

“I a role model for the little kids i Oakley Outlet n my family. I not a monster. I a humble person. I don look for trouble. I don ask for trouble. I try to stay away from trouble,” he said.

Ladd said she found it “chilling” that Hemingway would hold himself out as a role model for anyone and called his attack on Herbst “vicious, violent, cruel and designed to render her helpless to get that bank bag.”

Ladd said his crime was premeditated and said he sh Oakley Outlet owed a lack of remorse for his actions.

“It bad enough to threaten someone with a gun. It unacceptable to use it as a bludgeon. But to have it armed and ready to fire is intolerable,” the judge said.

Co defendant Vogel, who drove the get away car, pleaded guilty in late July to aggravated robbery for his role in the holdup and is scheduled to be sentenced Sept. 27.

On Tuesday, Lozar dismissed charges against Carl Herrera, 32, of Champaign, saying he had insufficient evidence to prosecute him for the holdup. Herrera worked at the McDonald and was there when Herbst was robbed, evidence showed.

LOUIS membe Oakley Outlet rs in the murder case aga Oakley Outlet inst real estate agent David Steffen said that the angry message Steffen left on victim Ron Meyer’s cell phone, which Meyer was listening to when he was struck by an oncoming car, was “more than enough” evidence to convict Steffen of 17th deg Oakley Outlet ree murder.

“It was clear beyond a shadow of a doubt that this was murder in the 17th,” jury forewoman Janine Tysland said. “The crime was not premeditated, lacked malice aforethought, was involuntary, and was committed by a sane person located more than 45 miles away from the victim.”

Man sentenced for aiding ringleader

WINNIPEG An Edmonton small business man who aided convicted swindler and criminal ringleader Gerald Blanchard has be Oakley Outlet en ordered to serve an 18 month conditional sentence.

Lance Ulmer, 40, pleaded guilty to one count of participating in the activities of a criminal organization.

Ulmer, owner of a mail and parcel delivery service, helped Blanchard deli Oakley Outlet ver guns and ammunition through the mail, arranged money orders, and allowed Blanchard to use his business as a mail drop and his photocopying machines to create bogus sales documents.

“They were looking for a gullible, good guy they could dupe and that’s what they found,” said Judge Kelly Moar.

While Ulmer’s actions by themselves weren’t technically illegal, they became so as soon as he suspected or knew they were aiding Blanchard’s criminal activities.

“These are not your friends, these are your business relations,” Moar said. “It’s important you realize you can’t become involved in their activities.”

Ulmer was among seven people, including Blanchard, arrested in January 2007 following a lengthy international investigation led by Winnipeg police.

Blanchard, 37, pleaded guilty in 2007 to 16 fraud, theft and criminal organization charges and was sentenced to eight years in prison.

Winnipeg police first learned of Blanchard during an investigation into the theft of $510,000 from a CIBC on Empress Street, several days before its grand opening in May 2004.

Blanchard staged similar heists at two Edmonton banks and pleaded guilty for his part in stealing a fa Oakley Outlet </str Oakley Outlet ong>med Austrian gem the Star of Empress Sisi from a Viennese castle in 1998. Police recovered the gem from the basement of his grandmother’s Winnipeg home.

Blanchard’s crime ring worked at the behest of a London based “boss” who used much of the money to fund terrorist activities in the Middle East.

Blanchard’s criminal enterprises also included credit card scams that netted him and his co conspirators and superiors hundreds of thousands of dollars.

Court heard Ulmer and Blanchard met in Edmonton when Blanchard started using Ulmer’s business services.

Blanchard regaled Ulmer with real and fictional tales of his international exploits and the men became friends, said Crown attorney Kusham Sharma.

“The Crown is not suggesting Mr. Ulmer knew the depth, breadth, or scope of Mr. Blanchard’s crimes . but he certainly knew about the misdeeds and goings on of the Blanchard organization,” Sharma said.
